CABIN RENTAL CONTRACT
Kicking Back Cabin, Owner Cabin
PROPERTY: 108 Weaver Creek Overlook, Blue Ridge, GA, 30513
This agreement constitutes a contract between the guest(s) & 108 WCO LLC dba Kicking Back Cabin and the properity owners. Guest acknowledges & understands that by signing this agreement, he/she/they states that he/she/they has read & understands the written policies provided within and agrees with all statements included herein.
1) Guest confirms that at least one guest, who will be at the cabin throughout the rental period, is at least 25 years of age, or older.
2) PROPERTY DAMAGE: Guest acknowledges and understands that he/she is financially responsible for any and all property damage that may occur during the stated rental period which can reasonably be attributed to the rental party’s negligence or abuse.
3) SECURITY/DAMAGE DEPOSIT: If you are booking direct, we will place a hold on your card for $500 that will be released after checkout, provided no damage claim is submitted. Additionally, the guest may forgo the $500 security deposit and purchase a $35 non refundable insurance policy to cover any damages. If house rules are broken and/or there are damages, there will be a damage claim submitted and your security deposit will be charged.
4) LOSS OF SECURITY DEPOSIT: Guest agrees to leave the property in the same general clean and undamaged condition it was when you arrived. Guests are responsible for any damage, abuse, excessive cleanup requirements, or loss caused by any member of the guest(s) party to the property or its contents during guest(s) occupancy. Guest acknowledges that any damages or violations may result in the loss of all, or part, of the $500.00 security deposit and that we reserve the right to further bill him/her for additional cleaning or repairs.
5) DISPUTES: This Agreement shall be governed by and interpreted in accordance with the laws of the State of Georgia and shall be treated as though it were executed in the County of Fannin, State of Georgia. Any action relating to this Agreement shall be instituted and prosecuted only in the Fannin County Superior Court, Georgia. Guest(s) specifically consent to such jurisdiction and to extraterritorial service of process.
6) GUEST COUNT: Guest agrees that the premises shall be occupied by no more than the number of people paid for and stated herein and that the maximum number of guests is 10 (ten). Occupancy is limited to registered guests only. Occupancy by more than the stated number of guests, or more than 10 guests, will result in the termination of the rental and the forfeiture of all rental fees, and deposits. Please notify us at least 24 hours before arrival if your guest count changes.
7) LOSS OF PERSONAL ITEMS: Guest acknowledges and understands that each guest, or guardian, is solely responsible for any loss by any person while in residence including the loss of money, jewelry or any personal items. We will do our very best to return any lost or forgotten items, at a charge of $30 plus shipping & handling, plus the cost of parcel insurance if requested.
8) NO PETS – Guest acknowledges that no pets or animals are allowed inside the house. Guest acknowledges that failure to follow this rule will result in the security deposit being forfeited and guest agrees to be charged for any additional cleaning fee's up to and including furniture and/or décor replacement and the guest will be required to vacate the property immediately upon receiving notice of said breach.
9) EARLY DEPARTURE/LATE ARRIVAL POLICY: Guest acknowledges that no refunds will be made for early departures or delayed arrivals. Further, no refunds or schedule changes will be made due to inclement weather.
10) CHECK-IN/CHECK-OUT TIME: Guest acknowledges and understands that check-in time is no earlier than 4:00 PM. You are welcome to check with us the night before to see if arriving any earlier on the arrival date is possible. Check-out time is no later than 11:00am on the date stated in the rental period above. Housekeeping needs adequate time to prepare the property for the next guest. Guest acknowledges that not leaving by stated check-out time, without permission, will be assessed a rate of $50.00 per hour (assessed at the start of each hour).
11) NO PARTIES/NO FIREWORKS/NO ATVs/ NO DISCHARGING OF FIREARMS:
Guest acknowledges that the occupancy and use of the premises shall not be such as to place the property in danger of damage or to disturb and/or offend area neighbors or residents. We reserve the right to terminate this agreement and request loud or unruly guests to vacate the premises immediately. Said discharge shall not result in the refund of any rental fees or deposits.
12) NO SMOKING: Guest acknowledges that this is a non-smoking cabin. If it is found that any member of the rental party, or guest of the rental party, has smoked (cigarettes, cigars, pipes, vapes or any other substance) inside the cabin, the security deposit will be forfeited. The entire cabin is designated as a No Smoking Area. In addition, no candles or incense can be burned in the cabin for fire safety reasons and to prevent unwanted odors. If it is found that smoking has occurred in the cabin/smoke odors or damages are present in the cabin, the security deposit will be forfeited and guest agrees to be charged for any additional cleaning required to remove the smell, up to and including furniture and/or décor replacement.
13) TV: TV’s are SMART TV’s and connect to the internet. You may use your own streaming account to use services such as NetFlix, Disney+, YouTubeTV, et al.
14) HOLD HARMLESS: Guest acknowledges and understands that each and every guest, or guardian, is solely responsible for any accident or injury to any person while in-residence, or on the property and that the Owner accepts NO legal or financial responsibility. Guests, and guardians, assume all risk of injury or other loss resulting from any recreational activity and will hold the Owner harmless with respect thereto. Guest(s) hereby agrees to indemnify and hold cabin referred to as Kicking Back Cabin and/or the business 108 WCO LLC, and/or the property owners harmless from any and all claims, including those of third parties, arising out of or in any way a result of the Guests use of the premises or items therein.
15) WILDLIFE: Guest acknowledges that the cabin is located in the mountains of North Georgia. As such, you are likely to encounter wildlife (deer, bears, raccoons, snakes and bugs of various types, including wasps and/or hornets, etc). Neither the business 108 WCO LLC nor the owners of the property nor the cabin referred to as Kicking Back Cabin accept responsibility for any injury caused by said wildlife.
16) OWNER’S CLOSET - There is a locked closet. This is a storage area for cleaning supplies and nothing of value is kept in it. PLEASE NOTE: Your deposit will be forfeited if either of the locks or the doors are broken or tampered with.
17) UTILITY FAILURES – Guest acknowledges that the owners will not be held responsible for the failing of any other company due to said company’s error or service interruption. (i.e. electricity, internet, water, gas, etc.) However, we will do everything humanly possible to remedy any issue in the shortest time possible.
18) INTERNET - No guarantee can be made that the internet service provided will be compatible with the Guest’s device. No technical support for the connection is available. The functionality of the connection cannot be guaranteed. Should the broadband connection not function for any reason, no liability is taken by either the owner or the Host, and they cannot be held liable for any losses resulting from the loss of connection. The Service is intended to allow Guests to access the internet for legitimate purposes only. The Guest undertakes to the Host that their behaviour while using the Service will be lawful, honest and proper. The Service may not be used in such a manner as to host a web or other server, send or facilitate the sending of bulk e-mail or collect third-party personal data without appropriate consent. The Host may terminate the Guest’s use of the Service at any time without notice if becomes aware of any behavior that has a negative impact on the Host’s equipment or network or the use by other customers of the equipment or network or the internet in general, or which damages, or has the potential to damage, the Host’s reputation or standing
19) OUTDOOR GAS GRILL - The gas grill uses propane gas for cooking. DO NOT PUT CHARCOAL in the gas grill. Pull the grill away from the side of the house and the deck railing when in use. Turn gas on/off before and after use.
20) FIREPLACES: Fireplaces inside the cabin and on the deck is equipped with propane gas logs which must not be disturbed. Guest agrees that under no circumstances will any member of the party uninstall the logs, rearrange the logs or burn anything other than the propane provided in the interior fireplace(s). To do so may cause damage to the logs and may also allow poisonous carbon monoxide to leak into the cabin which could prove harmful to your party or future guests. Any evidence of tampering will result in the loss of your deposit. Never leave fireplace unattended. Fireplaces are seasonal and will NOT be operable from May 1st – September 30th. Gas log fireplaces provide a great deal of heat which is not needed in warmer months.
21) HOME FURNISHINGS, EQUIPMENT, ETC. –Guest acknowledges that furniture, bedding, linens, towels, utensils, or any other property belonging to the owner may not be removed from the premises for ANY reason. Guest further acknowledges that loss of these items, as well as damage to any property or furnishings in excess of normal wear and tear will be charged to you, the guest(s). Moving of any furniture or décor is not allowed. Further, do not take any inside furniture or chairs outside or on the porches or bring any of the exterior furniture inside the cabin.
23) HOT TUB - Hot tubs are cleaned before each Guest's arrival. Guests will be charged additional fees if bodily fluids or food are left in the hot tub. Hot tub covers are for insulation and heating purposes and are not designed to support a person or persons. Do not sit on the hot tub covers. Guests will be charged a replacement fee for hot tub covers that are damaged during their renting of the property. Hot tubs are not to be used as swimming pools. Hot tubs are used for relaxation purposes and should never be used for more than fifteen-minute intervals. Women who are pregnant, or think they may be pregnant, should not use the hot tub. Children under twelve years old, and anyone with heart conditions or any other health issue should NOT be in the water with a temperature higher than 98° F for more than fifteen minutes at a time. Excessive heat in the hot tub can cause damage to an unborn baby, collapsing of heart valves in young children, strokes, and heart attacks in anyone with existing heart defects. Children under the age of eighteen should not be left unattended or without adult supervision while in a hot tub. The temperature should never be set over 104° F. The chemicals and excessive heat in the hot tub from overuse can cause skin and eye irritation, rashes, fever, and ear infections. 108 WCO LLC and the property owners are not responsible for any injuries, accidents, medical issues, or medical bills. All guests will use the hot tub at their own risk and discretion. Please use caution.
24) CAMERAS ON PROPERTY – Guest acknowledges security cameras are located on the exterior of the property and monitor the exterior of the home for security purposes only. No cameras are located in the interior of the home. Footage remains private and may be used for liability reasons. It in no way infringes upon the expectation of privacy in these public areas. To disable or obscure the cameras is prohibited and may result in eviction without refund.
25) COMMUNICATIONS – Guest agrees that, during their stay, they will be required to answer calls or other communications, including but not limited to text messages, emails, etc., from host or their agents. Failure of guest to respond to communications from host or their agents, during their stay, will result in a breach of this agreement. Should such a breach occur, guests will be required to vacate the property immediately upon receiving notice of said breach.
26) CANCELLATION POLICY
Direct Booking and VRBO: Travelers who cancel at least 14 days before check-in will get back 100% of the amount they've paid. If they cancel between 7 and 14 days before check-in, they'll get back 50%. Otherwise, they won't get a refund.
